AIS & BABA Compliance Requirements for Manufacturers
AIS (The American Iron and Steel) Act Requirements for Valve Manufacturers
The AIS Act was first introduced as part of The Consolidated Appropriations Act of 2014. The American Iron and Steel (AIS) Act requires that all iron and steel products must be produced in the United States when used in the project for construction, alteration, maintenance, or repair of a public water system or treatment works. The Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Fund (DWSRF) fall under AIS requirements.
The EPA holds authority to grant or deny AIS waivers for the following reasons:
- Applying AIS requirements would be inconsistent with the public interest
- Iron and steel products produced in the U.S.A. are not available in acceptable quantities or quality
- Use of U.S.A. produced iron and steel products would increase the cost of the project by more than 25 percent
BABA (Build America, Buy American) Act Requirements for Manufacturers
The Build America, Buy American (BABA) Act went into effect May 14, 2022. The BABA Act expanded on the requirements of the AIS Act to include additional requirements that all metal, manufactured products, and construction materials used for an infrastructure project must be produced in the United States in order to receive federal financial assistance.
The BABA Act outlines the following requirements for materials used for a project in order to receive federal funding:
- All iron and steel products are required to be produced in the U.S.A.
- 50% or more of all manufactured products are required to be produced in the U.S.A.
- All construction materials are required to be produced in the U.S.A.
BABA requirements expand into all federal funding, including the Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Fund (DWSRF). The BABA Act also added requirements to a variety of other EPA programs. However, there are three possible waiver options for the BAB Act which the EPA can grant. They are a Public Interest Waiver, a Non-availability Waiver, and an Unreasonable Cost Waiver.
